Personal Injury
We represent people who are injured at accidents where another party is at fault. We do not defend individuals who are being sued for personal injuries. We offer free consultations for personal injury cases. If we accept your case, we generally have a contingency fee agreement where you do not have to pay up front, but we are paid a percentage of your recovery. We will go over the terms of this in detail in person and in writing. Please complete the personal injury intake form if you would like me to review your case.
If you are involved in an accident, gather all relevant documents. Make sure to get down all of the relevant information, including: all drivers licenses, insurance company and policy number, license plate, and the home addresses and telephone number for all drivers and witnesses. You have to report this to your own insurance carrier, and do not have to speak with the other car’s driver if you have insurance or legal representation.
It is very important that you seek prompt medical treatment if you are injured. If you do not go right to the emergency room, go to your own doctor within 24 hours of the accident. A delay or gap in treatment can hurt your claim.
You do not have to give a statement to the driver at fault, or their insurer. It is best to consult with an attorney about this. You must cooperate with your own insurance company.
We can not give you an estimate of the worth of your case without specifically analyzing your facts, and without knowing exactly the extent and duration of your injuries. Most cases settle but there is of course no guarantee that your individual case will settle. Therefore, we still prepare for trial to protect your interests and have the best negotiating position.
What is the statute of limitations? This depends. If you are suing the government you must filing a claim within 180 days. Otherwise, generally, under California law you have two years to file your suit with the court or substantial rights can be forever lost. A simple case you may settle before the two year statue of limitations. Delay can often hurt you even though you may be within the statue of limitations. Witnesses move, evidence can be lost, it is best to secure an attorney early to preserve evidence, give you advice and protect your rights.
